We have no control over the information provided by users which is displayed on our site. Please use caution and common sense in using the Online-Equine. The completion of any auction is specifically the responsibility of the Buyer and Seller.

The information contained in the Buyers and Sellers Guides help to show the uses, terms, and responsibilities of Online-Equine and the members. This information will serve as general instructions. 

Specific Policies

  1. Online-Equine Sales Company (the sales company) is part of Pekabu Productions, L.L.C. and is run as a service for the horsemen in the Internet community. We take no responsibility for the condition or quality of items presented herein. Online-Equine.com disclaims any guarantees expressed or implied on items or services listed on our site.
  2. Bidders or prospective buyers are advised to thoroughly read and examine all information provided on any animal you are interested in bidding on or purchasing. If you are unsure, ask.
  3. All sales are "as is" and no animals can be returned unless there is an arrangement made between buyer and seller. Online-Equine Sales Company has NOT vet-checked any of the animals for sale. There is no guarantee by the sales company of soundness or any other qualities of any animal posted on this site unless expressly made by the seller. In these cases, the guarantee is strictly by the seller and not by the sales company. Any misrepresentation must be dealt directly with the seller and not through the sales company.
  4. Online-Equine Sales Company does not participate in any exchange of money or arrange for the transportation or deliver of any animal purchased through the sales company. We do not take responsibility for any guarantees or representations made by the seller or the bidder. All details of the transaction must be completed by the seller and the buyer. The seller is to provide any necessary paperwork, registration papers, and transfers if applicable. The seller is also obligated to make known all defects, if any, prior to the time the auction begins. If the seller defaults in this clause, the buyer my have the right to refuse subject animal. In which case, the seller is still responsible for all charges incurred with the sales company. Buyers may, at their own expense, have a veterinarian examine any animal prior to the sale by making arrangements with the seller. If misrepresentation is determined on the seller's part, his/her registration and contract with the sales company will be terminated immediately. The name of the seller and/or business will be placed in the sales company's file as an undesirable.
  5. Online-Equine Sales Company is committed to advertising, displaying all information, automated communication and bidding to give the seller the best opportunity to sell his animal(s) for the price he or she wants.
  6. All horses sold through Online-Equine Sales Company will be required to have a current negative Coggins test.
  7. The seller must list if mares are in foal. If they are listed as being vet checked or guaranteed in foal, buyer has the right to have said mare checked. If mare proves not to be in foal, buyer has the right reject purchase. Seller will then be responsible for all sales expenses and veterinary examination. If mare proves to be in foal, buyer is responsible for veterinary examination. Any agreements regarding return breeding, etc. are solely between the seller and buyer.
  8. BIDDING
  9. The highest bidder will be the buyer. If a dispute should arise between two or more bidders, the horse will then be auctioned between the disputing parties. If they chose not to bid, the last bid recognized by the sale company will then be the buyer.
  10. Bidders may place a "Maximum" bid and the auction will place their bids automatically until their maximum bid is met. If it is surpassed, an outbid notice will be sent via email. This service is for your convenience and by no means a requirement.
  11. Online-Equine Sales Company has the right to decline any bids made by individuals who have dfaulted in prior auctions or any individuals whose auction privileges have been terminated.
  12. Bidders may contact sellers through the auction format to request pertinent information or ask additional questions about the item or animal consigned.
  13. Sellers retain the right to no sales or pass out any animals they have consigned as longs as a minimum bid has not been met or surpassed.
  14. PURCHASE
  15. The highest bidder will receive notice at the close of auction of winning bid. Payment terms are to be made with the seller. The cost of shipping is not included in the auction price. All shipping fees are to be paid by the buyer unless other arrangements have been made between buyer and seller. All details of the transaction are the responsibilities of the seller and buyer. If buyer has not made payment to seller within agreed amount of time set by seller, it will then be considered a default sale. Any legal fees that may be incurred by the seller to obtain purchase price and any other fees agreed upon between both buyer and seller including attorney fees and costs will be the responsibility of the default buyer.
  16. In the unlikely event a bid is not honored, the registered buyer's registration and contract with Online-Equine Sales Company will be terminated. Seller may then request a resale of the animal in question or request the sales company to accept the next highest bid. If any prior bid cannot be enforced, seller agrees not to hold the sales company responsible and may request the animal be placed in another auction for resale.
  17. All responsibilities, care, maintenance, and expense of an auctioned animal become the responsibility of the buyer once the seller has received the purchase price. This will be binding in the case of injury, illness, or death of any animal after it has been sold. After payment has been received by the seller from the buyer, seller is to release the animal and all current paperwork, registration, transfer, breeder's certificate, coggins, etc.
  18. These terms and conditions of sale shall constitute a contract between buyers, sellers, and Online-Equine Sales Company and shall be equally binding among all parties.

PLEASE NOTE

It is a violation of law to make bids in a false name or with an invalid credit card, even if our software initially accepts such a bid. Please be aware that even if you do not give us your real name, your web browser transmits a unique internet address to us which can be used by law enforcement officials to identify you. Please don't ruin the fun for everyone by testing our auction with false bids. This puts you at substantial personal legal risk. Fraudulent bidders will be prosecuted to the fullest extent of the law. Currently, both the FBI and the US Secret Service are responsible for investigating all Internet fraud cases.
